Oikeudenmukaisen oikeudenkäynnin toteutuminen CAS-menettelyssä
(2023)
The purpose of this thesis is to examine the arbitration process of the Court of Arbitration for Sport (CAS). The evaluation of the procedural process is based on Article 6 of the European Convention on Human Rights, which defines the right to a fair trial. In this thesis, attention is paid in particular to how CAS’s independece and impartiality are realized, and whether the CAS’s appeal procedure complies with the requirement of orality and publicity. This work uses legal doctrinal research as a research method. The main sources in the thesis are international legislation, more precisely Article 6 of the European Convention on Human Rights and the judgments of the European Court of Human rights derived from it, legal literature and scientific articles on the subject. The importance of soft law regulation is also great in this work, because the processes of CAS and international sports federations are regulated by their own instructions and rules, which can be read within the scope of soft law. As a conclusion of the thesis, it can be considered that although the starting point of CAS’s operation is its status as an arbitration court, it is possible to evaluate it from the perspective of the European Convention on Human Rights in the same way as a national court or other authority. CAS has developed in the direction of better fulfilling the requirement of a fair trial in Article 6 of the European Convention on Human Rights, for example by improvig the possibility of the parties to have their case heard in open doors in disciplinary disputes. However, regarding the impartiality and independence of CAS, there are doubts about how impartially the arbitrators selected for CAS have been appointed, as the international sports federations and other sports organizations have a disproportionately large influence on the appointment of arbitrators in relation to athletes, which can be considered to set those parties in an unequal position....
